Practice Areas

I

Criminal Law

The firm’s criminal practice covers defence of the suspect, the defendant and the convicted person at every stage of the proceedings, as well as representation of the victim and the injured party of a criminal offence. Engagement begins as early as possible, because steps taken during the preliminary investigation often shape the outcome of the trial.

  • We assist the client during questioning, detention and arrest — whether in flagrante or otherwise — follow investigative acts, and ask the prosecutor to administer evidence that supports the defence.
  • We oppose the prosecutor’s request for pre-trial detention or house arrest, appeal the measure ordered, and seek its replacement or annulment when the legal conditions are lacking.
  • We prepare the defence on the basis of the evidence administered, challenge its admissibility where there are procedural breaches, examine witnesses and experts and, when in the client’s interest, seek summary trial.
  • We defend administrators, company owners and others prosecuted for fraud, forgery, abuse of office, corruption or money laundering — often in matters that require analysis of accounting and banking documentation.
  • We represent the victim during investigation and trial, bring the civil claim within the criminal process, and seek compensation for pecuniary and non-pecuniary damage.
  • We draft appeals to the Court of Appeal, recourses to the High Court and applications for revision of final judgments, as well as applications to the Constitutional Court and the European Court of Human Rights when the state has violated fundamental rights.
II

Civil Law

In civil practice we represent claimants and defendants in disputes arising from obligations, ownership, contracts and liability for damage. Every matter begins with an open assessment of prospects and cost, before the client decides whether to pursue litigation or a negotiated resolution.

  • We draft statements of claim, defence statements and counterclaims, prepare the evidence and represent the client at first instance, on appeal and before the High Court.
  • We handle claims for debt recovery, performance or termination of contracts and the consequences of non-performance, including late-payment interest and penalties.
  • Compensation for damage is another service for which we represent the injured party or the person sued for damage caused by accidents, defamation, breaches of personality rights or contractual non-performance, with assessment of pecuniary and non-pecuniary damage.
  • We seek security measures or other urgent measures such as conservatory attachment, and pursue compulsory enforcement of judgments and other enforceable titles through the bailiff.
  • When the client’s interest so requires, we negotiate and draft out-of-court settlement agreements, with the aim of avoiding a lengthy process.
III

Administrative Law

Administrative practice serves individuals and businesses facing decisions of public bodies. Above all we help the client understand whether the administrative act is lawful and what the deadlines and remedies are, because appeal deadlines are short and unforgiving.

  • Challenging administrative acts: for this purpose we draft administrative appeals and claims before the administrative court for annulment or declaration of invalidity of the act, as well as applications to suspend enforcement.
  • Permits, licences and authorisations — obtaining, renewing and amending them, and opposing refusal, conditioning, suspension or revocation.
  • We represent the client in challenging decisions of the tax and customs administration, fines and interim measures, both administratively and in court.
  • We advise economic operators during participation in procurement procedures and prepare complaints before the Public Procurement Commission and, when required, claims in court.
  • Expropriation for public interest is of no less importance — a specific procedure in which we review the legality of the process and the assessment of compensation, and challenge it when it does not meet the standard of fair compensation.
IV

Commercial Law

In commercial matters we advise domestic and foreign companies throughout their life, from formation through to reorganisation or liquidation. Our aim is that partners’ and administrators’ decisions take the proper legal form from the outset, rather than problems being solved only once they have reached court.

  • Formation and registration of companies is essential: we incorporate limited liability companies and joint-stock companies, branches and representative offices, draft the statute and deed of incorporation, and carry out registration at the National Business Centre.
  • We prepare shareholders’ agreements, calls and minutes of the assembly, decisions on capital increase or decrease, transfer of quotas and changes in management.
  • We represent partners and shareholders in challenging decisions of company bodies, in claims for administrator liability and in procedures for exit from the company.
  • We handle and assist in disputes with suppliers, clients and commercial partners, from payment claims through to termination of long-term contracts.
  • We represent the debtor or creditor in bankruptcy and reorganisation proceedings, including recognition of claims and challenging of plans.
  • We offer ongoing advice on the company’s obligations toward regulatory bodies and on the legal risk of day-to-day activity.
V

Employment Law

We assist employees and employers at every moment of the employment relationship. In this field, advice given in time — before a contract is signed or before a disciplinary decision is taken — often avoids a later court judgment.

  • We draft and review individual and collective employment contracts, internal regulations and clauses on confidentiality and non-competition.
  • Termination of the employment relationship. For the employee we challenge unlawful dismissal without reasonable or justified grounds and seek reinstatement (under the civil service law) or compensation as appropriate. For the employer we advise on the proper dismissal procedure and on collective redundancies.
  • We pursue compensatory claims such as unpaid wages, overtime, leave, bonuses and social insurance contributions.
  • Discrimination, harassment and mobbing are of no less importance: we represent the employee in the complaint before the competent body and in the claim for protection of dignity and equality at work.
  • We assist the employer in investigating breaches, imposing disciplinary measures and preparing evidence in the event of judicial challenge.
VI

Family Law

Family matters require, beyond knowledge of the law, calm, trust and discretion. We approach each case putting the child’s interest first and, where possible, aiming for agreement between the parties before the conflict deepens.

  • Dissolution of marriage is a growing juridical-family act in our country; to protect the client’s rights we assist in divorce by mutual consent and represent the client in contested divorce.
  • We identify jointly owned marital property, draft division agreements and, in the absence of agreement, seek its partition in court.
  • Child custody is another point of particular importance in this procedure: we seek appointment of the custodial parent and regulation of the other parent’s personal relations with the child, based on the criteria of the child’s best interests.
  • We seek the fixing, variation or termination of the maintenance obligation and pursue its enforcement.
  • We represent the client in recognition and denial of paternity, in adoption and in appointment of a legal guardian.
  • We urgently seek protection orders and other protective measures for the victim and the children.
VII

Real Estate & Inheritance

The practice covers the full legal cycle of immovable property, from title verification before purchase through to resolution of ownership disputes, and also addresses inheritance matters. In Albania, careful verification of the property’s history is the first condition of a secure transaction. For this purpose:

  • We check the title to ownership, mortgages, encumbrances, attachments and registration status at the Immovable Property Registration Office before every transaction.
  • We draft and negotiate preliminary contracts, contracts of sale, gift, exchange and lease, and follow the process through to registration.
  • We carry out initial registration, correction of material errors and legalisation procedures for constructions when enabled by law.
  • We assist former owners in procedures before the Property Treatment Agency and in judicial challenge of its decisions.
  • We represent the client in boundary disputes, easements, unlawful occupation, claims for recognition of ownership, acquisitive prescription, partition of co-owned property, and related matters.
  • We advise developers and investors on construction, development, contracting, order and exchange contracts, on relations with landowners and on subsequent procedures.
  • We draft and attest wills, challenge wills where there are legal grounds, prepare certificates of heirship, carry out partition of the estate by agreement or in court, and assist with renunciation of inheritance. We also handle inheritance matters with a foreign element under Private International Law.
VIII

Immigration Law

We help foreign nationals, their families and the employers who hire them with procedures for entry, stay, employment and obtaining Albanian citizenship. Most refusals stem from incomplete documentation or filings outside the deadline, so preparation of the application is the most important part of the work.

  • We advise on the appropriate type of visa, prepare the documentation and application, and help in responding to refusals.
  • We handle procedures for obtaining permits for work, study, business, family reunification and long-term stay, including renewal and change of purpose.
  • We assist the employer and the foreign employee in the concurrent work-permit and residence-permit procedure.
  • Albanian citizenship is another practice pursued by this office: we prepare applications for citizenship by origin, by marriage and by naturalisation, and follow the procedure before the competent authorities.
  • We help spouses and children in obtaining a residence permit with a family member for the purpose of family reunification.
  • If the goal is not achieved, challenge of negative decisions applies: we appeal administratively and judicially against refusal, annulment or non-renewal of the permit.
  • We support companies in relocating employees and meeting immigration requirements, carrying out procedures in cooperation with employment offices.
IX

Deportation & Extradition

These procedures affect personal liberty and the right to remain, and their deadlines are often very short. For that reason matters in this field are handled with priority, in close coordination with the client’s family and, when needed, with specialised lawyers or law firms in the receiving or requesting state.

  • We challenge the deportation decision and the entry ban; for this purpose we seek suspension of enforcement and defend the client during administrative detention, seeking review of its lawfulness and alternative measures.
  • We protect fundamental rights in deportation and insist on respect for family life and on the prohibition of deportation to a country where the person risks inhuman treatment, referring to the case-law of the European Court of Human Rights.
  • We represent the person sought by a foreign state before the Albanian court in passive extradition proceedings, and oppose the request when the offence is political in nature, when documentation is missing under the statutory deadlines, when there is a risk of inhuman treatment, or when the ne bis in idem principle applies.
  • We assist in Albania’s requests to foreign states and in coordination with authorities and partner lawyers in the receiving country; we oppose or authorise active extradition through the giving of consent.
  • We review the lawfulness of an Interpol notice and seek its deletion when it conflicts with the organisation’s standards.
  • We assist in practice and seek release, variation, extinction, loss of force or replacement of the security measure ordered during the extradition procedure.
X

Contracts & Investments

We advise domestic and foreign investors on structuring, negotiating and closing transactions. A well-drafted contract anticipates disputes that may arise and makes clear who bears the risk, so we work closely with the client to understand the business objective before drafting the text.

  • Drafting and review of contracts — sale, services, supply, agency, franchise and confidentiality — as well as review of contracts proposed by the other party.
  • Negotiations through which we represent the client and protect their interests on the key issues: price, warranties, liability and termination of the contract.
  • Foreign investment — advice on the appropriate investment structure, company formation and obtaining licences and permits.
  • Due diligence — verifying the legal status of companies and assets before acquisition, and reporting risks and recommended measures.
  • We advise investors on procedures and contracts with public authorities such as public procurement, grants, concessions and public-private partnership (PPP).
  • We represent the client in arbitration, mediation and in court with the final aim of resolving disputes.
  • Intellectual property is of particular importance: we provide legal support and, beyond that, register and protect trademarks and copyrights connected with the business activity.
